Acceptance of terms
By creating an account or using Divvypool (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time — continued use after changes constitutes acceptance.
Eligibility
You must be at least 18 years old to use Divvypool. By creating an account, you represent that you are 18 or older and legally able to enter into a binding agreement. Accounts found to belong to minors will be permanently closed and any earnings forfeited.
Your account
You are responsible for maintaining the security of your account. You must not share your login credentials or allow others to access your account. One account per person — duplicate accounts are prohibited.
We reserve the right to suspend or terminate accounts at our discretion, including for violations of these terms, fraudulent activity, or behavior that harms other users or the platform.
How earnings work
Divvypool distributes 85% of payments received from survey partners (CPX Research) to users. The remaining 15% is retained by Divvypool to operate the platform. These rates may change with reasonable notice.
Earnings are distributed at the end of each calendar month to users who have connected a bank account via Stripe. We are not responsible for delays caused by Stripe, your bank, or incorrect account information.
Payout amounts are calculated based on your join position within a pool, your bonus multipliers, and the total number of participants at the time of payout. Estimates shown during the week are not guaranteed — final amounts are calculated at payout time.
Prohibited conduct
You agree not to:
- Create multiple accounts to game pool positions, bonuses, or referrals
- Submit fake, dishonest, or low-quality survey responses
- Use bots, scripts, or automated tools to interact with the platform
- Manipulate the referral system by self-referring or using fake accounts
- Attempt to reverse-engineer, scrape, or exploit the platform
- Engage in any activity that harms other users or the integrity of the pools
Violations may result in immediate account suspension, forfeiture of pending earnings, and legal action where applicable.
Referral program
Referral bonuses are earned when a user you referred completes surveys and receives payouts. Referral earnings are capped at $10.00 per referred user over the lifetime of their account. We reserve the right to modify or discontinue the referral program at any time. Referral bonuses earned through fraudulent means will be reversed.
Tax responsibilities
You are solely responsible for reporting and paying any taxes owed on earnings received through Divvypool. If your earnings exceed $600 in a calendar year, Stripe will issue a 1099-NEC form on our behalf. By using the Service, you agree to provide accurate tax information when requested.
Disputes and chargebacks
If you believe a payout was calculated incorrectly, contact us at
support@divvypool.com within 30 days of the payout date. We will investigate and correct genuine errors. Initiating a chargeback or payment dispute with your bank without first contacting us may result in account suspension.
Intellectual property
All content, branding, and software on Divvypool is owned by Divvypool and protected by applicable intellectual property laws. You may not reproduce, copy, or redistribute any part of the Service without prior written permission.
Disclaimers
The Service is provided “as is” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that any specific earnings will be achieved.
Survey availability depends on our partners (CPX Research) and may vary. We are not responsible for the content of surveys or decisions made by survey partners regarding survey qualification or disqualification.
Limitation of liability
To the maximum extent permitted by law, Divvypool and its owners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the total amount paid to you in the 90 days preceding the claim.
Termination
You may close your account at any time by contacting us at
support@divvypool.com. Any pending earnings at the time of closure will be paid out at the next monthly distribution, provided your bank account is connected. Earnings will be forfeited if the account was closed due to a terms violation.
Governing law
These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class action lawsuits related to the Service.
